Likewise, it does not guarantee the truthfulness, accuracy, completeness, and\/or authenticity of the data provided by users.<\/p>\n\n

AGROPRO DIGITAL FARMING SL. shall not be liable, either indirectly or secondarily, for damages of any kind arising from users\u2019 use of the Services and Content of the application or that may arise from the lack of accuracy, accuracy, and\/or authenticity of the data or information provided by Users, or from a user impersonating a third party in any working through this application. Users can manage irrigation, fertigation, pests and diseases, and the Farm Manager for their plots through the VEGGA app from anywhere.<\/p>\n\n

9. Customer Service.<\/strong><\/p>\n\n

<\/strong>If the user notices any issues with the installation, programming, or operation of the application, they may report them to AGROPRO DIGITAL FARMING S.L. by sending an email to hola@veggadigital.com<\/a>.<\/p>\n\n

<\/p>\n\n

10. Exercising Your Rights.<\/strong><\/p>\n\n

<\/strong>As a user, you may exercise your rights of access, rectification, restriction of treatment, erasure, objection, and data portability, as set forth in Articles 13 through 18 of Organic Law 3\/2018 of December 5 on the Protection of Personal Data and the Guarantee of Digital Rights, which you may exercise by sending your request to our email address hola@veggadigital.com<\/a>.<\/p>\n\n

Furthermore, the user has the right to revoke the consent initially provided and to file complaints regarding their rights with the Spanish Data Protection Agency (AEPD).<\/p>\n\n

11. The warranty for the VEGGA application provided by AGROPRO DIGITAL FARMING S.L.<\/strong><\/p>\n\n

In accordance with the provisions of Royal Decree-Law 7\/2021, dated April 27, transposing European Union directives on competition, the prevention of money laundering by credit institutions, telecommunications, tax measures, the prevention and remediation of environmental damage, the posting of workers in the provision of cross-border services, and consumer protection\u2014which amends Article 120.2 of the General Law for the Protection of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1\/2007, dated November 16.<\/p>\n\n

Article 120 provides that: In the case of digital content or services, or goods with digital elements, when the contract provides for the continuous supply of digital content or services for a specified period of time, the seller shall be liable for any lack of conformity in the digital content or services that occurs or becomes apparent within the period during which the digital content or services are to be supplied in accordance with the contract. However, if the contract for the sale of goods with digital elements provides for the continuous supply of digital content or services for a period of less than three years, the liability period shall be three years from the time of delivery.<\/p>\n\n

Consequently, the warranty for digital products will be valid for 2 years and covers any defects related to programming, the continuous delivery of content, or digital services.<\/p>\n\n

<\/p>\n\n

12. Notices.<\/strong><\/p>\n\n

<\/strong>All notices, demands, requests, and other communications that must be made by the parties in connection with these General Terms and Conditions must be in writing and shall be deemed to have been duly made when delivered in person or sent by regular mail or to the email address hola@veggadigital.com<\/a>.<\/p>\n\n

<\/p>\n\n

13. Nullity and Ineffectiveness of Provisions.<\/strong><\/p>\n\n

If any provision contained in these General Terms and Conditions is declared, in whole or in part, null and void or unenforceable by a court or arbitral award, Such declaration of nullity or ineffectiveness shall affect only that provision or the part thereof that is null and void or ineffective, with the remaining General Terms and Conditions remaining valid, and such provision\u2014or the part thereof that is affected\u2014shall be deemed not to have been included.<\/p>\n\n

14. Out-of-Contract Dispute Resolution.<\/strong><\/p>\n\n

In accordance with the guidelines set forth in Law 7\/2017 of November 2, which transposes into Spanish law Directive 2013\/11\/EU of the European Parliament and of the Council of May 21, 2013, on alternative dispute resolution for consumer disputes.<\/p>\n\n

The new regulations require that, in the event of a dispute between a consumer and a business (Article 3 of the aforementioned Law), it may be resolved through an out-of-court procedure before the competent regional authority (Article 26 of the aforementioned Law). Sales transactions conducted on VEGGA with AGROPRO DIGITAL FARMING S.L. are governed by Spanish law.<\/p>\n\n

In the event of any conflict or discrepancy arising from the interpretation or application of these contractual terms and conditions, the courts and tribunals that, where applicable, will have jurisdiction over the matter shall be those designated by the applicable legal regulations governing competent jurisdiction, which, in the case of end consumers, shall be based on the place of performance of the obligation or the domicile of the purchasing party.<\/p>\n\n
